Introduction
Nichi is a product that records and shares daily life through pictures. You can record the details of your daily life through Nichi, and edit pictures in a personalized way by using stickers, photo frames, backgrounds, fonts and other tools in Nichi. In order to provide you with the said services, we will collect your necessary personal information. This Privacy Policy aims to help you understand the types of personal information we will collect and how we will use and protect your personal information, and also introduced you to our privacy control functions, which you can use to independently control the use of your personal information. To help you read and understand, we have defined some specific terms attached hereto as “Appendix 1: Definitions”.
Nichi app has several versions, including but not limited to the IOS version and the Android version. Please select the version matching the installed terminal device when using Nichi. The personal information that Nichi may collect depends on the version of Nichi app you use, the specific type/version of terminal device you use and the functions you use.
This Privacy Policy applies where you access and use our products and services through Nichi’s web terminal, mobile terminal (including but not limited to app and mini program), software development kit (SDK) and application programming interface (API) for third-party website and app.
Please read this Privacy Policy carefully and use Nichi’s services by checking the “Agree” box or clicking the “Agree” button after you fully understand and consent to the contents hereof. According to GDPR, COPPA and other applicable laws and regulations, you shall be at least 13 years old (in the United States) / 14 years old (in the United Kingdom) / 16 years old (in Europe) / 18 years old (in most countries) to use our game services independently. Without prior consent of your parents or statutory guardian, we will not voluntarily collect personal data of children under the said ages. If you are a child below any of the said ages, we will ask you to obtain the consent of your parents before creating an account for you and collecting relevant personal data, and make every reasonable effort to verify that the consent is given by your parents or statutory guardian to the extent permitted by the existing technologies. We encourage parents to instruct their children not to provide personal data when using the Internet.
In case of merger, acquisition, reorganization, bankruptcy or other similar events of Miuke, we will issue an announcement in advance to disclose the details of the event and the information of Miuke’s successor. With express prior consent of you or your guardian, your personal data may be transferred to Miuke’s successor.
We may periodically modify, adjust or revise any term of this Privacy Policy. We encourage you to check this Privacy Policy from time to time to ensure that you are aware of any changes. For the updated terms, especially the major changes related to your rights as a data subject, we will notify you in the form of a pop-up window before you use our services, set up a check box or otherwise obtain your consent again. I. How do we collect and use your personal information
Personal information refers to all kinds of information recorded electronically or otherwise that can identify you or reflect your activities, either used alone or in combination with other information. According to the principles of legality, legitimacy and necessity, we will only collect the information necessary to realize the functions of our products.
(I) Personal information provided by you directly or collected by us automatically
1. Nichi’s service functions
Nichi’s service functions consist of those services provided by Nichi and services provided by third parties:
(1) Nichi provides you with stickers, photo frames, colors, fonts and other tools for you to edit your pictures in a personalized way.
(2) Nichi also taps into the services provided by the third party, such as the third-party payment (both WeChat payment and Alipay payment) services provided by Shanghai Jianmi Network Technology Co., Ltd. Your choice to not use the third-party services will not affect your use of other functions. Please note that the third-party service providers’ processing of your personal information will be subject to the privacy policy of the third-party service providers.
2. Personal information to be collected and system privacy access permissions to be required in using Nichi’s functions
(1) Personal information to be collected in using Nichi’s functions
1) Device information
In order to ensure your normal use of Nichi services, more accurately locate you and solve the problems you encounter when using Nichi services, improve and optimize Nichi services experience and ensure the security of your account when you use Nichi, we will collect device attribute information (for example, your hardware device model, operating system version, device configuration, unique device identifier, IMEI, MAC address and IDFA), device location information (such as location information obtained through GPS, Bluetooth or WIFI signals), device connection information (browser type, Telecom operator, language used) and device status information (such as device sensor data, device application installation list). For the information collected from your various devices, we may associate them so that we can provide you with consistent services on these devices.
2) Log information
Like most Internet services, our server will automatically record your requests when accessing Nichi, such as the contents you browse, your IP address, browser type and language used, hardware device information, operating system version, network operator, date, time and duration of your access to the service. Please note that this is the basic information we need to collect to ensure the normal operation of software and services.
3) Account registration information
If you use the purchase record synchronizing service through Nichi, you need to register and log in your Nichi account. When registering an account, you may need to provide us with an email address or choose to use our services through a third-party platform.
4) Nichi’s function/service information
If you use the picture editing function/service, we will obtain your permissions for fetching photos from and save photos into your photo album, to support you to select photos from the photo album and save the photos into the photo album after editing. If you do not provide such information, you will be unable to use the photo or video editing functions/services, but your normal use of other daily functions/services of Nichi will not be affected.
5) Third party function/service information
Nichi taps into third-party SDKs for the use of Nichi’s and third-party platforms’ services on different mobile devices, the realization of your mobile device identity authentication, mobile device security, the receipt of information pushed, the logging in to the third-party platform account, the sharing of information through the third-party platform and payment security. Some of those third-party SDKs may require a permission for accessing your device and collect your relevant information, so that you can normally use corresponding functions on different mobile devices or third-party platforms. We list in Item (V), Part III hereof the names of these third-party SDKs with the function of personal information collection, the functions/services provided by them, links to their privacy policies, the permissions to be obtained and the type of personal information to be collected according to the categories of functions/services. Please read the privacy policies of the third party to understand their data collection and processing policies before using the third-party services.
Miuke will fulfil our duty of prudence to ensure your information security, update and explain to you the latest situation of the third-party SDKs tapped into by Nichi as soon as possible.
6) Contact information collected when you participate in the operating activities (optional)
Nichi will organize operating activities for newly launched services and functions from time to time. If you participate in relevant operating activities, we will collect your identity information (such as name) and contact information through the operating activity interface to get in touch with you, and may collect your transaction account information when we distribute operating rewards to you. Your information to be collected in different operating activities may be different. Please refer to the specific rules of relevant operating activities for details. If you do not participate in relevant operating activities, you do not need to provide the said information.
We allow you to control the personal information available to us. While you provide personal information, we will let you choose whether to receive information about future new products, publicity or services. In addition, some “emails” we send you, such as news emails (depends on the website you visit), contain methods to cancel receiving them, and you have the opportunity to choose not to use some settings or functions.
At any time, if you want to stop sharing personal information with third parties who are not our affiliates and/or stop receiving information about new products, services or publicity (by e-mail or mail), you may contact us through the contact information specified in Article VIII.

However, if you do so, you need to change the user settings every time you visit our website, but you may not be able to log in or use the services or functions provided by Miuke that depends on cookies because of such change.
You may restrict Miuke’s use of cookies by changing the settings on your browser. Taking Google browser as an example, you can choose to clear your cookies through “Privacy Settings and Security - Clear Browsing Data” in “Settings” in the drop-down menu at the top right.
III. How do we share, transfer and publicly disclose your personal information and the third parties we tap into
(I) Share
Unless with your prior authorization or consent, we will not share your personal information with any third party other than Miuke’s affiliates, except that, after processing, it cannot be used to identify a specific individual and cannot be restored.
1. We may share personal information under the following circumstances with your authorization or consent:
(1) Third-party product or service providers. When you use third-party products or services, we will, with your authorization, provide the information necessary for the use of third-party products or services to third-party product or service providers, so that they can provide products or services to you based on the relevant information. When you use the upload and storage services provided by Alibaba Cloud Computing Co., Ltd., we will, with your authorization or consent, share with Alibaba Cloud Computing Co., Ltd. your following personal information: Your device information (MAC address, IP address, unique identifier (IMEI; Android ID; IMSI; IDFA; IDFV), hardware model, operating system version), and WIFI address.
If you do not provide such information, it will only prevent you from using the upload and storage services, and will not affect your normal use of other service functions of Nichi.

(2) Software and hardware service platforms or providers. When software service providers, smart device providers or system service providers collaborate with us to provide services to you, we may collect and share your necessary information (which may include your device’s MAC address, IP address, unique identifier (IMEI; Android ID; IMSI; IDFA; IDFV), hardware model, operating system version), and provide it to such providers after de-identification. You may refuse to provide such information without affecting your use of other services.
(3) Advertising and consulting service providers/advertisers. Without your authorization, we will not share your personal information with advertising and consulting service providers. You authorize us to share with advertising or consulting service providers or advertisers information that, after processing, cannot be used to identify you and cannot be restored by the recipient, such as anonymized user portraits, so as to help them improve the effective reach rate of advertising and analyze the use of our products and services without identifying you.
2. We will investigate the data security of companies, organizations and individuals with whom we share personal information, sign strict confidentiality agreements with them, and require them to process personal information in accordance with our instructions, this Privacy Policy and any other relevant confidentiality and security measures.

(V) Third-party SDKs we tap into
In order to adapt to the use of Nichi and third-party platform services on different mobile devices, and achieve reception and push, third-party payment, information sharing through third-party platforms, advertising display and log collection (used to record downloads and installs of channel promotion, locate crashes, and improve experience, etc.), Nichi taps into third-party SDKs to support such functions/services. The third-party SDK providers include mobile device manufacturers, social platforms, communication operators and third-party payment institutions. Some third-party SDKs may require your device access permissions and obtain your relevant information, so that you can normally use corresponding functions on different mobile devices or third-party platforms. Different third-party SDKs may invoke different device access permissions and obtain and share different information. This may include obtaining your location information, reading/writing your external memory card, reading your phone’s status and identity, viewing WLAN connections, retrieving running applications/Bluetooth, obtaining device information (IMEI, Android ID, WIFI address, IDFA, etc.). Different third parties may use information in different ways and within different scopes. For details about the device access permissions required by third-party SDKs, how to collect and use and the purpose, method, and scope of sharing your personal information with a third party, please refer to the relevant service agreements and privacy policies of third-party SDKs.
Please understand that the SDK developed by Miuke for the realization of product functions of Nichi and the safe and stable operation is not included in the aforementioned third-party SDKs, and its application for requiring your device access permissions and obtaining your relevant information has been explained in this Privacy Policy in combination with product functions.
IV. How do we store and protect your personal Information
(I) Storage life
We guarantee that we will only store your personal information for a period of time necessary to realize the purpose of our services or under the conditions and period stipulated by laws and regulations. If you cancel your account or voluntarily request to delete your personal information or withdraw your consent to collect part of your personal information during the use of Nichi’s products and services, we will delete the relevant information after fulfilling the obligation of legal storage in your region. After you cancel your account or voluntarily delete the above information, we will not use your personal information commercially, but we may anonymize your personal information for use.
(II) Security measures
1. We will collect, use, store and transfer user information in accordance with the industry’s mature security standards and specifications, and inform you of the purpose and scope of use of relevant information through user agreements and privacy policies.
2. We take information security very seriously. We have set up a dedicated team responsible for R&D and application of a variety of security technologies and procedures. We will conduct security background checks on the head of security management and the personnel in key security positions. We have established a sound information security management system and an internal security incident handling mechanism, etc. We will take appropriate industry-standard security measures and technologies to store and protect your personal information to prevent the loss, unauthorized access, public disclosure, use, modification, damage, or leakage of your information. We will take all reasonable and feasible measures to protect your personal information. According to our security management system, the leakage, damage or loss of personal information is listed as the most serious security incident, the company’s highest-level emergency plan will be activated once it happens, and it will be handled by a joint emergency response team formed by the security department, the government relations department, the legal department, etc.

1.4. 新服务和功能运营及客服处理
Nichi日常会不时针对新推出的服务和功能发起运营活动,如推出的新服务需要处理您的个人信息或申请设备系统权限,且此前未经过您的授权同意,我们会另行获得您的同意,其中,如涉及敏感个人信息的处理,我们会另行获得您的单独同意。
如果您参加相关运营活动,我们可能会通过运营活动界面收集包括但不限于您的身份信息、联系方式、交易帐号类信息,以便与您取得联系、向您发运营奖励等。若您不参加相关运营活动则无需提供前述信息。
如您对于我们提供的产品服务有疑问或需要客服介入进行争议处理时,为了验证您的身份、定位您的问题,可能需要您提供您的身份信息进行核验。为了保障通话质量,确保纠纷得到妥善解决,我们可能会保存您与我们的沟通记录,包括通话记录、您提供的与您的争议解决相关的信息,您使用或提供的联系方式。

当您使用Nichi日常时,为了保障您正常使用Nichi日常服务,更准确定位并解决您在使用Nichi日常服务时遇到的问题,改进及优化Nichi日常的服务体验,保障您的帐号安全,预防、发现、调查欺诈、危害安全、非法或违反与我们的协议、政策或规则的行为,以保护您、我们或我们的关联公司、合作伙伴及社会公众的合法权益,我们会收集您的设备信息、日志信息及其他与登录环境相关的信息。
当app处于后台状态下,统计分析服务可能依然运行,并可能收集Android ID信息。
请您理解,当您将处于设备屏幕中Nichi日常切换到设备后台运行时,由于部分设备机型及系统原因,您此前使用Nichi日常相关功能而产生的信息收集行为,可能无法立即停止,从而导致短暂的后台信息收集行为。

您可以随时通过您的设备提供的权限设置方式开启或关闭部分或全部权限,从而拒绝Nichi日常收集相应的个人信息。在不同设备中,权限显示方式及关闭方式可能有所不同,具体请您参考设备及系统开发方说明或指引。

当我们要将信息用于本隐私政策未载明的其它用途时,会事先征求您的同意。当我们要将基于特定目的收集而来的信息用于其他目的时,会事先征求您的同意。
2. 我们如何共享、转让、公开披露、委托处理您的个人信息以及所接入的第三方

为了适配在不同手机设备上使用Nichi日常以及第三方平台服务,实现您的手机号一键登录、登录第三方平台帐号、通过第三方平台分享信息、 接收信息推送以及第三方支付,Nichi日常接入了第三方SDK。上述第三方SDK提供方包括手机设备厂商、社交平台、通讯运营商和第三方支付机构。 部分第三方SDK可能会调用您的设备权限、获取您的相关信息,以便您在不同的手机设备或第三方平台上正常使用相应功能。 不同的第三方SDK所调用的设备权限类型以及所获得的信息可能不同,可能包括获取您的位置、读/写您的外部存储卡、读取您的手机状态和身份、查看WLAN连接、 检索正在运行的应用、检索您已安装扽应用列表、蓝牙。关于第三方SDK具体调用的设备权限类型,以及如何收集、使用您的个人信息,建议您参考第三方SDK的相关服务协议及隐私政策。 如果您希望进一步了解我们所接入的第三方SDK情况,请您阅读 第三方SDK情况说明。
2.6 委托处理与共同处理
为了更好地为您提供服务,我们可能委托第三方合作伙伴处理您的个人信息。我们仅会出于合法、正当、必要、特定、明确的目的委托第三方合作伙伴处理您的信息。我们会严格限制受托方的信息处理目的并要求受托方采取充分的数据安全保障手段。如果第三方合作伙伴将您的信息用于我们未委托的用途,其将另行征得您的同意。我们委托的授权合作伙伴包括广告、分析服务类的授权合作伙伴。我们会在遵守行业通行的安全技术前提下,委托这些合作伙伴处理与广告投放、广告效果、广告触达率有关的信息。未经您有效授权,我们不会将可以直接识别您个人身份的信息委托第三方合作伙伴处理。如您主动为特定第三方合作伙伴留下您的联系方式、地址信息等个人信息以供其与您取得联系,其将直接处理您的个人信息。
在共同处理场景下,我们同样会按照法律法规要求与合作方签署符合法律法规要求的相关协议,并履行相关个人信息保护义务。
3. 我们如何保存及保护您的个人信息

我们将在提供服务所需的期限内保存您的个人信息,但法律法规对保存期限另有规定、您同意留存更长的期限、保证服务的安全与质量、实现争议解决目的、技术上难以实现等情况下,在前述保存期限到期后,我们将依法、依约或在合理范围内延长保存期限。
在超出保存期限后,我们将根据法律规定删除您的个人信息或进行匿名化处理。

Nichi日常愿一直陪伴您,若因特殊原因导致Nichi日常产品停止运营,我们将在合理期间内在产品或服务的主页面或站内信或向您发送电子邮件或其他合适的能触达您的方式通知您,并将停止对您个人信息的收集,同时会按照法律规定对已收集的您的个人信息进行删除或匿名化处理。

附:名词解释
个人信息是指以电子或者其他方式记录的与已识别或者可识别的自然人有关的各种信息,不包括匿名化处理后的信息。个人信息包括姓名、出生日期、身份证件号码、个人生物识别信息、住址、通信通讯联系方式、通信记录和内容、帐号密码、财产信息、征信信息、行踪轨迹、住宿信息、健康生理信息、交易信息等。
敏感个人信息是指一旦泄露或者非法使用,容易导致自然人的人格尊严受到侵害或者人身、财产安全受到危害的个人信息,包括生物识别、宗教信仰、特定身份、医疗健康、金融账户、行踪轨迹等信息,以及不满十四周岁未成年人的个人信息。
设备是指可用于使用Nichi日常产品和/或服务的装置,例如桌面设备、平板电脑或智能手机。
设备信息可能包括您用于安装、运行Nichi日常SDK的终端设备的设备属性信息(例如硬件型号,操作系统版本及系统情况,设备配置,国际移动设备身份码IMEI、国际移动用户识别码IMSI、网络设备硬件地址MAC、广告标识符IDFA、供应商标识符IDFV、移动设备识别码MEID、匿名设备标识符OAID 、集成电路卡识别码ICCID 、Android ID、硬件序列号等设备标识符)、设备连接信息(例如浏览器的类型、电信运营商、使用的语言、WIFI信息)以及设备状态信息(例如设备应用安装列表、设备传感器信息)。
日志信息是指我们的服务器所自动记录您在访问Nichi日常时所发出的请求,例如您的IP 地址、浏览器的类型和使用的语言、硬件设备信息、操作系统的版本、网络运营商的信息、您访问服务的日期、时间、时长等您在使用我们的产品或服务时提供、形成或留存的信息。
